Terms And Conditions
Any orders placed with Lighting Mirror Man will be processed exclusively on the basis of the following terms and conditions of sale. Your usage of our website to purchase products and/or services from Lighting Mirror Man implies your agreement to these terms and conditions as set out below, unless expressly varied in writing by a director of Lighting Mirror Man on behalf of the company. Usage of the website in general is governed by our terms of usage and privacy policy which are available on our website.
General Information
Lighting Mirror Man is a solely operated company to which we do not belong to any trade organisations, professional bodies or supervisory authorities, nor do we subscribe to any specific codes of conduct.
Definition of Terms
Goods refers to any product or service provided by Lighting Mirror Man to the purchaser.
Customer, client, purchaser or ‘you’ refer to the person entering into a contract to purchase goods from Lighting Mirror Man.
Us; we; our; or ‘The Company’ refer to Lighting Mirror Man, it’s website and its parent company.
Ordering From Lighting Mirror Man
Notwithstanding a detailed quotation provided by Lighting Mirror Man, no order shall be binding on Lighting Mirror Man unless and until it has been accepted in writing, either physically or electronically, by Lighting Mirror Man.
Any times or dates given for completion or delivery of goods shall be binding on Lighting Mirror Man. Such liability shall not extend to delays beyond the control of Lighting Mirror Man including but not limited to, failure by shippers to collect or deliver, unavoidable problems within the production process, or inability to contact the client.
By their nature goods do not have a redeemable value and no refunds or credits for goods correctly supplied will be accepted.
Customer Service
Lighting Mirror Man endeavours to provide service to customers on a minimum 5 day per week basis, except in; cases outside of the control of Lighting Mirror Man, national holidays, staff shortages, unavailability of telecoms and/or computer systems.
Lighting Mirror Man endeavours to reply to all emails within one working day, and answer phone calls within 60 seconds. However, should this target not be met, no liability shall be imposed on Lighting Mirror Man unless explicitly advised otherwise by a nominated representative of Lighting Mirror Man.
Payment
All goods shall be paid for at the time of order via the Lighting Mirror Man website.
No orders shall be sent for dispatch until full payment has been received and acknowledged.
Orders made via Bacs or other electronic means, shall be “live” up until 5 working days after the order has been placed.
Failure to have the relevant funds transfered into our account by this time, will result in your order being canceled and futher orders will be strictly made via some other means (i.e Paypal or other “instant” payment method)
All prices are inclusive of Value Added Tax (where Value Added Tax is applicable) and is charged at the appropriate rate.
All prices are inclusive of ‘Standard Delivery’ costs, but do not include faster turnaround or delivery options.
Credit facilities are not offered by Lighting Mirror Man at this time.
Quality & Liability
Any shortcomings or defects in goods supplied must be made known to Lighting Mirror Man within 3 working days of delivery. 3 working days are measured from the delivery time supplied by the courier. Any such goods must be returned to Lighting Mirror Man (at the cost of the purchaser) for inspection before any corrective action may be taken.
Nothing herein shall impose any liability upon Lighting Mirror Man in respect of any defect in the goods arising out of the acts, omissions, negligence or default of the purchaser, its servants or agents including without prejudice to the generality of the foregoing handling and storage of the goods.
Nothing herein shall have the effect of excluding or restricting the liability of Lighting Mirror Man:
death or personal injury resulting from its negligence insofar as the same is prohibited by U.K. statute, or;
Under sections 12,13,14 and 15 of the Sales of Goods Act 1979 to a purchaser who is dealing with a customer (as defined by section 12 of the Unfair Contract Terms Act 1977).
Lighting Mirror Man shall not be liable for any costs, claims or damage arising out of any act of tort or omission or breach of contract or statutory duty calculated by reference to profits, income production or accruals or loss of such profits, income production or accruals or by reference to accrual of such, claim, damages or expenses on a time basis.
The liability of Lighting Mirror Man to the purchaser for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances exceed the price of the goods.
If the purchaser shall be in breach of any of their obligations under this contract, Lighting Mirror Man may (without prejudice to Lighting Mirror Man’s rights subsequently to determine the contract for the same cause should it so decide) suspend further deliveries of goods without notice until any defaults by the purchaser are remedied.
Cancellation of Orders
If the purchaser has paid by Credit or Debit Card, we reserve the right to not refund any processing charges we have incurred via the payment gateway used.
We reserve the right to consider any manufacturing costs or refuse a refund if an order has already entered production (if the item has been on back order).
The order status supplied to customers is not necessarily a guarantee of the ‘live’ status of their order and advice should be sought by the purchaser directly from Lighting Mirror Man when choosing to cancel an order.
Changes to Orders
Changes to order details may result in additional charges being required, to be paid before shipment of the final order.
Delivery of Goods
It is the sole responsibility of the client to enter the correct delivery address in the delivery address fields at the time of placing the order and no liability can be held by Lighting Mirror Man if entered incorrectly.
If delivery of customers order has not been made within 7 days (UK) and 14 days (Europe and USA) from date of order being placed and no contact has been made by the customer no later than 45 days from the date of order. We reserve the right to refuse a refund or a replacement.
If goods are returned to us as a result of delivery failure we reserve the right to charge the customer for a further delivery, and any additional processing costs incurred by Lighting Mirror Man.
Overall Terms & Jurisdiction
No statement, description, information, warranty or recommendation contained in any catalogue, price list, advertisement or communication or made verbally by any of the agents or employees of Lighting Mirror Man shall be construed to enlarge, vary or override in any way these conditions.
Any concessions made or latitude allowed by Lighting Mirror Man to the purchaser shall not affect the strict rights of Lighting Mirror Man under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and effect.
The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the purchaser and Lighting Mirror Man agree to submit to nonexclusive jurisdiction of the English courts.
Returns
If an item you receive is damaged in transit or faulty on arrival, we will be happy to replace it.
In this circumstance WE will pay the cost of your return carriage into you Paypal account (if appropriate) in these circumstances. Please use standard postal options only. We do not refund the cost of premium/expedited carriage options.
Replacement items can only be dispatched once the faulty item has been received by us.
If an item you receive has been purchased in error or you change your mind, we are happy to refund on the cost of the item ONLY when the item has been received by us in the same condition it was sent out and is of a re-saleable condition. In this circumstance we cannot refund the cost of your return postage.
When returning an item to us, please contact us either by our contact us page or by telephone, so we can supply you with an RMA number for your returned item.
Please also remember to include your details in the return parcel and also include the RMA number and a reason for returning the item.
